Indenture Between Robert Hartland and James Barrett, 1838


 
Summary:  An indenture dated 1st February 1838 between Robert Hartland and James Barrett of Priors Court, Staplow for the purchase of land near Temple Court, Bosbury.

  This Indenture made the first day of February one thousand eight hundred and thirty eight Between Robert Hartland of the parish of Hartlebury in the county of Worcester gentleman of the one part and James Barrett of Priors Court in the parish of Ledbury in the county of Hereford, gentleman, of the other part Witnesseth that in consideration of five shillings to the said Robert Hartland paid by the said James Barrett, the receipt whereof is hereby acknowledged, He, the said Robert Hartland, doth bargain and sell unto the said James Barrett his executors administrators and assigns All those pieces or parcels of pasture land situate at or near a place called Berry Mears near to the Turnpike Road leading from Bosbury towards Ledbury containing by estimation three roods, be the same more or less, late in the occupation of the said Robert Hartland and now of the said James Barrett and which last mentioned premises were bought and purchased by the said Robert Hartland of and from Miss Mary Stone.

  And also all those the sites of two dwelling houses with the gardens and lands thereto adjoining and belonging situate in the parish of Bosbury and called or known by the name of the Broad Stone, situate on the right of the Turnpike Road leading from Ledbury to Bosbury opposite a messuage or dwelling house called Temple Court House late in the occupation of the said Robert Hartland and now of the said James Barrett. All which said hereditaments and premises are situate lying and being in the parish of Bosbury in the county of Hereford And all and singular ways, paths passages, waters, watercourses, Commons, Common of pasture, privileges, easements, profits, commodities, emoluments, rights, members and appurtenances whatsoever to the said hereditaments and premises belonging or appertaining And the reversion and reversions remainder and remainders yearly and other rents issues and profits of the said hereditaments and premises and every part thereof.

  To have and to hold the said pieces or parcels of land or ground hereditaments and all and singular other the premises hereby bargained and sold by the said Robert Hartland and their appurtenances unto the said James Barrett his executors administrators and assigns from the day next before the day of the date of these presents for the term of one whole year Yielding and Paying therefore unto the said Robert Hartland his heirs and assigns the rent of one peppercorn on the last day of the said term if the said rent shall be lawfully demanded. In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written.
