SWITHUN BUTTERFIELD’S
SURVEY OF BOSBURY, 1578
INTRODUCTION.
In his magnum opus, Swithun Butterfield, his arms proudly
included at the beginning and the end, tells us that he is deputy to Giles Allen who is registrar to John
Scory, the Bishop of Hereford. He describes being born in Uxbridge, Middlesex and baptised on the fourth
of January in the second year of the reign of Edward VI, which he says is the year 1547 (1548 New Style).
Checking this date in the second year of Edward’s reign gives 1548 (or 1549 New Style) although it
seems unlikely SB would have made an error. It appears that Swithun Butterfield studied at Pembroke College,
Cambridge, as in his will of 1611 he bequeathed manuscripts and money to buy books for the college library.
The books he left included a 1587 copy of the Holinshed’s Chronicles.
Bishop John Scory commissioned a survey of the Bishopric Estates, and Swithun Butterfield produced this volume, handwritten on vellum, in 1581 having spent, he tells us, over three years on the task. The lands were owned by the see of Hereford as tenant-in-chief to the monarch.
Bosbury is the first parish to be listed and the first 26 folios are in Latin giving details of revenues from individual landowners. Folios 27 to 61 are in English and and describe parcels of land and their tenants. Here is a transcription of these pages prepared by the members of the VCH Ledbury Wills Group, Gill Bateman, Janet Funke, Liz Keatley, Celia Kellett, Veslemøy Lunt, Val MacDonald, Jerry Pearce and Barry Sharples under the guidance of Dr. Sylvia Pinches. A special thank you to Dr. Janet Cooper for giving us access to her transcription done concurrently with ours.
The book is numbered by folio or sheet and pages here are referred to as 26r 26v etc. where r is short for ‘recto’, the front page which carries the folio number and v is short for ‘verso’, the back of the page, which is not numbered.
This is not a literal transcription but a readable text with the spelling largely corrected to modern English. However all names of people and places have been set down as written by Butterfield although sometimes suggested present-day names have been added in [brackets] to assist the reader. SB uses both ‘lyeth’ and ‘lyinge’
TECHNICAL NOTE: There are three forms of ‘tenure’ or land-holding.
Customary land was land occupied in return for labouring on the lord’s demesne land. The descent of these holdings was governed by the custom, or accepted rules, of the manor in question. This usually involved payment of money termed heriot or feudal relief (effectively an inheritance tax). The commonest form of customary tenure, which evolved in late medieval times, was known as copyhold tenure, because each tenant would be given a copy of the entry recording his succession in the manor court roll.
Freehold land was held primarily in return for a fixed rent, and its descent was not governed (or recorded) by the manor.
Forelet land was land granted or leased by the Bishop of Hereford
during his lifetime and which could be taken back by his successor; it was normally held for
money rent only and could not passed on by inheritance.

court with view of frankpledge held there before John Warmecombe esquire under steward there and
Richard Willisonne, gent, surveyor on 25 April in the year of the reign of Edward VI, 1548,
Thomas Farley and John Alcock senior, customary tenants of the lord of this manor, swore on
their oaths that lately Eleanor Frewen, widow, surrendered into the hands of the lord one
unbuilt messuage and one yardland of customary land in Bosbury called Townesendeslande
through John Halfeild with the intention it be regranted to the aforesaid Eleanor for the
remainder of her life and after her death to John Scudamore, son of John Scudamore of Homelacy
esquire, and to Joan Payne, now wife of the said John Scudamore the son, and daughter of the
said Eleanor ... Granted ...
Two important houses are mentioned in Folio 21 v.
John Hope holds a built messuage called Racyesland [now Bosbury House] and John Halfehyde
alias Halfield, gent., holds a built messuage, Le Grange. The Grange
is not mentioned afterwards.

Demesnes

The Customary Messuages, Tenements, Cottages, and Customary lands, hereafter following; and this is to be noted, that the Customary lands the Jury did estimate after the rate of 4 pole broad and 40 pole long (every pole or perch to contain 16 foot and a half foot, every foot 12 inches: according to the statute measuring): to be an acre. And did guess the same by view as rightly as they could (but not estimated by measuring as the demesnes, parsonage and forelet lands were): Also the said Jury do say that by the Custom of this Country 60 acres of land is a yard land, 30 acres half yard land and 15 acres a Noke of land: Every acre containing so much grounds as taketh for seed in a seasonable time, a bushel or strike of wheat: So after that rate every acre as is hereafter written do contain one acre and half (according to the Custom of this country) And one acre of measured grounds (according to the statute) will receive one bushel (or strike): and half a bushel or strike of wheat for seed. James Barnes holdeth one cottage with a barn, a curtilage and a garden adjoining late in the tenure of James Halfeld (in which cottage he now dwelleth) and the place where the same cottage is builded lyeth between the foresaid cottage of Johgn Wynsmores on the east part and the parish land on the west part. Memorandum that the forelet land which is in Bosbury was sometime customary land: therefore the number of yard lands, which is in the Red Book *, cannot be now; because since the making of the book much customary land is now forelet, more than was in those days. In the Red book it appeareth there should be in ^the Manor of^ Bosbury 22 yard land; there is now 21 yard land: but I think some have not so large a measure for a yard land as they should have.
Also it appeareth in the Red Book that there should be of demesnes in arable land, 433 acres and a half which was then valued to be worth 4d. the acre, sum £7 14s 3d.And of the demesnes in meadow ground, 23 acres which was then valued to be worth 2s. the acre, sum 46s. And of the demesnes in pasture land, 12 acres and a half which then was valued to be worth 12d. the acre, sum 12s 6d.

This Indenture made the second day of October in the fourth year of the reign of our sovereign lord Edward the 6th by the grace of God of England, France and Ireland, King, Defender of the Faith and in earth the supreme head of the church of England and Ireland, [1550] between the Reverend father in God, John, Bishop of Hereford, of the one party And John Harford of Bosbury in the county of Herefordshire, gent. on the other party. Witnesseth that the said Reverend father hath demised, granted and to form set and by these presents hath demised, granted and to form setteth unto the said John Harford all that his site of the manor of Bosbury with the warren of the same, with all manner of houses and buildings, domain lands, meadows, leasowes, pastures, the ground and wood called Birchwood, tithes and glebelands with all and singular their appurtenances to or with the said manor or site belonging used or occupied which be now in the tenure or occupation of the said John Harford. And also one other pasture called The Meadow home, lying in Bosbury aforesaid, now in the occupation of one Joan Heywarde, widow. And moreover the said Reverend father hath demised granted and to form set And by these presents demiseth, granteth and to form setteth unto the said John Harforde all manner of tithes of corn, grains and hay by reason of the church or parsonage of Bosbury aforesaid to the said Reverend father by any means belonging or appertaining with all glebe lands, meadows, leasowes, pastures, barns, granaries, oxhouses with all other commodities whatsoever they be thereunto belonging or in any wise appertaining which be now in the tenure or occupation of the said John Harforde. And, if it happen the said yearly rent of £17 6s. 8d. aforesaid to be behind (unpaid) in part or in all at any time during the said term by the space of six weeks next after any of the said feasts in which it ought to be paid if it be lawfully asked, then the said John Harford covenanteth and granteth for himself, his executors and assigns to and with the said Reverend father and his successors by these presents that it shall be lawful for the said Reverend father and his successors into all and singular the premises to re-enter and the same to have again as in his or their former estate; any thing in these present Indentures to the contrary notwithstanding. And the said Reverend father doth covenant and grant to and with the said John Harford, his executors and assigns that it shall be lawful to the same John Harford and his executors and assigns to cut down any tree or trees within the said ground or wood called Birchwood during the term of four score and nineteen years aforesaid to be employed and occupied for the building and reparations and other necessaries in and upon the aforesaid manor without any impeachment of waste of the said Reverend father and his successors. re-enter and the same to have again as in his or their former estate anything
in these indentures to the contrary not withstanding. And the said
Reverend father covenenteth, promiseth and granteth for him self & his
successors to & with the same John Harford, his heirs & assigns by
these presents, that it shall be lawful for the same John, his executors and
assigns at all times during the said term to abate and pull down at his &
their pleasure or pleasures any house or houses standing on any part of the
premises, without any manner of impeachment of waste, so that the same John his
heirs and assigns do within 3 years after building caust [caused] to be builded
as good or better within the same soil at their own proper cost & charge
the moeity of the barn and granary aforesaid within the Manor of Bosbury
aforesaid only excepted. And the said Reverend father coventeth and
granteth for him and his successors to & with the said John Harford, his
executors & assigns by these presents that the same John, his executors & assigns
shall take & have upon all the premises & upon every part & parcel thereof
all manner of reasonable estovers as housebote, haybote, firebote, hedgbote, cartbote &
waynebote * during the said terms without impeachments of waste. And
furthermore the said Reverend father covenenteth & granteth for his & his successors,

Witnesseth that where the said John Harforde holdeth by Indenture bearing date the 2nd day of October in the fourth year of the reign of our late sovereign Lord Edward the Sixth, King of England etc. the site of the manor of Bosbury with the warren of the same with all manner of houses, buildings, demesne lands, meadows, leasowes and pastures etc. (as in the lease recited before) Where also the said John Harforde holdeth by one other Indenture bearing date the 22nd day of October in the 32nd year of the reign of our late Sovereign Lord King Henry the eighth the parcel or parcels of lands hereafter mentioned, that is to wit, one parcel of pasture forelet containing 6 acres lying in Bosbury aforesaid called Stroud hills late in the tenure of Thomas Myntredg [Mintridge] by rent by year 2s. etc. (as in the lease before verbat[im] of all the forelet lands) for this demise: which parcel became void the 30th day of May in the sixth year of the reign of our said late Sovereign Lord King, Edward the sixth, by the death of the Right Reverend Father in God, John, late bishop of Hereford. The said Reverend father etc. demiseth, granteth etc. to the said John Harforde the said site of the manor of Bosbury and all other the premises etc. To have etc. for the term of fifty-one years, the said term to begin and take his commencement as the same shall fall void Yielding the several rents reserved etc. at the feast and days in the said Indentures specified. And if it happen the land rent etc. to be unpaid by the space of 2 months being demanded then to re-enter etc.
Nota: some think this lease to be void because the Dean of Hereford was then in Ireland at the confirmation: and left his proxy. But the confirmation was not made by virtue of that proxy but an hebdomedary [a member of the cathedral staff who appointed persons to carry out weekly offices etc.] or precedent etc.

The indenture for the finding of the officers meat at the courts [in margin]
This indenture made the 30th day of April in the sixth year of the reign of our sovereign Lady Elizabeth, by the grace of God of England, France & Ireland, Queen, defender of the faith etc. [1564] between the Reverend Father in God, John, Bishop of Hereford, on the one party, and Richard Harford, of Bosbury in the county of Hereford esquire, upon the other party, Witnesseth that before the said Richard Harforde as assignee of John Harford, his father deceased, amongst other things, hath & holdeth to farm of the said Reverend Father the site of the manor of Bosbury aforesaid & all houses & buildings now being upon the said site builded, for many years yet to come as, by divers indentures & writings thereof made, more plainly may appear; and by one of the said indentures, made the 24th day of February, in the first & second years of the reign of our late sovereigns Lord & Lady King Phillip & Queen Mary, [1555/56] between the Reverend Father in God Robert, late bishop of Hereford, one the one party and the said John Harforde one the other party: The said John Harforde did covenant & grant for him his executors & assigns, to & with the said late Reverend Father & his successors, that he, the said John Harforde his executors & assigns, should from thenceforth from time to time, as oft as need should require until the end of the years comprised in the same indenture, well & sufficiently repay sustain & maintain all the houses & buildings then built, or after to be built, in & upon the said site, and the same so repaired & builded to leave at the end of the said years: with houses & buildings, the said Reverend Father and his successors were bound sufficiently to repair unto the said John Harforde his executors & assigns by an indenture, bearing date the second day of October in the 4th year of our sovereign Lord King Edward the 6th, as by the said indentures more plainly may appear. The said Reverend Father, John, now bishop of Hereford, as well for that the mansion & dwelling houses built upon the said site be very ruinous & in decay, and the soil or ground whereupon the same are builded is very low, moist & unwholesome to inhabit or dwell upon, as for divers good causes & considerations him moving doth, by those present release, exonerate and, for him & his successors, clearly discharge the said Richard Harforde his executors & assigns, and the executors & assigns of the said John Harforde of & for the reparations of all the said houses & buildings (except the barns, stables, ox houses & sheep houses) and doth further covenant & grant by those present for him & his successors to & with the said Richard Harforde his executors & assigns, that it

shall be lawful to the said Richard Harforde, his executors & assigns, at all time & times hereafter, to take & pull down all the said houses and buildings, or any part or parcel thereof. (the said barns, stables, ox houses & sheep houses only excepted) and the timber, brick, iron, stone and other stuff thereof to bestow & employ in or upon the reparations of the said barns, stables, ox houses & sheep houses, or otherwise, at the will & pleasure of the said Richard Harforde his executors and assigns: And the said Richard Harforde, in consideration thereof, doth covenant & grant by these presents for him, his executors & assigns, to & with the said now Reverend Father and his successors, that he the said Richard Harforde and his assigns, shall find the steward, surveyor, receiver, and bailiff of the said Reverend Father & his successors and their servants that shall & ought to attend at the Law Days & courts at Bosbury, their horse meat & man’s meat, meet & convenient for them when they shall [be] kept at Bosbury aforesaid the two accustomed Law Days & every other cost baron that shall be kept there, for the causes of the said Reverend Father or his successors, during the years in the longest lease yet to come, of the said site of the said manor: but if any courts baron shall there be kept at any time hereafter for any special matters between one tenant and another, wherein the said Reverend Father & his successors shall be no party: Then neither the said Richard, nor his executors nor assigns, shall be bound to any charges by reason of the said courts for the said officers, their servants or horses or any of them. Witnesseth that the said Reverend father for considerations him moving hath demised granted and leased and by these presents doth demise grant and lease unto the said Richard Trovell all that his demesnes or pasture called Birchwood set lying and being in Cradley in the county of Herefordshire aforesaid between thelands of John Arundell on the one side called Bachcombe And the grove or coppice called Storidge on the other side together with the waste ground hereunto adjoining [sloping] down from the house of Humphrey Stokes upon the coppice woods near unto the house of Thomas Nash in Cradley aforesaid.
To have and to firm hold the said demesnes, pasture and waste ground and all woods and underwoods thereupon growing with all and singular their appurtenances unto the said Richard Trovell, his executors and assigns from and after the day of the date hereof unto the end and term of 21 years from henceforth next ensuing and fully to be completed, ended and expressed. Yielding and paying therefore yearly unto the Reverend father and his successors, Bishops of Hereford, 2s.0d. of lawful money of England at the feast of St. Michael the Archangel only.
And if it happen the said rent to be behind and unpaid by the space of one month next after the said feast, and it being lawfully demanded, that then it shall be lawful to the said Reverend father and his successors into the said demesnes or pasture and every part and parcel thereof to enter and distrain. And the distress thereof had and taken with him to detain until the said rent with the arrears thereof (if any such be be fully satisfied and paid).
And the said Richard Trovell doth further covenant and grant for him, his executors and assigns to pay and deliver to the said Reverend father and his successors one couple of fat capons at the feast of Xmas only. In witness etc.
[in another hand] Nota John Harforde, gentleman, had also a lease of this Birchwood for 29 years (expired dated Anno Rex Henri octavi 33) [33rd year of the reign of Henry VIII - around 1541].
In the last pages of the book, Swithun Butterfield adds the following notes explaining his purpose in examining the Court Rolls and then gives his conclusions on the Customs. A literal transcription of this section was published by Canon Arthur Bannister in 1928 in ‘The English Historical Review’, from which these amended extracts are taken.
Read all, or leave all. As concerning the Customs following, I have perused the Court Rolls belonging to the said Bishopric,and have here set down an easy direction for those who have any occasion heareafter to resort to the said Rolls for the finding of matters which concern the same Customs, viz. of the manors of Bromyard,Whitbourne, Bishops Frome, Bosbury, Cradley, Colwall and Coddington, Eastnor, Ledbury, Upton Bishop, Ross,Sevenhampton and Prestbury (all which Manors were late the possessions of the Bishopric of Hereford): Further I have not read in the said Court Rolls (to my remembrance, and I have read them all which are extant in my keeping divers and sundry times, whereof there lack but few Rolls from the beginning of King Richard the Second until now) but that all the Customary Tenants which hold Customary Lands by Copy of Court Roll according to the custom of the Manors aforesaid (and being parcel of any of the said Manors) do hold the said Customary Lands by one Custom (except Cradley, which vary in heriots,because the Customary Tenants have them to ‘fee farm’).
In like manner the Customary Tenants which hold lands by Copy of Court Roll in the Manors of Berton, Shellwicke, Tuppesley [Tupsley],and Hampton, do hold the same lands within the same four Manors by the same Customs as do the Customary Tenants in the Manors aforesaid (except in these four Manors the youngest child is heir to his ancestor.)
Moreover in the Manor of Eton the Customary Tenants there do hold by the like Customs as do the four Manors beforesaid, but in this Manor the eldest child is heir to his ancestor. And in this Manor of Eton one of the CustomaryTenants is yearly chosen [to be] the Lord’s Reeve, and to gather his Rents and perquisites of Court in the same Manor. Also there is in these five Manors last named contention between the Lord and the Tenants for their heriots, wherein they would vary from the other Manors. Where I have above-said Customs to be kept by the Customary Tenants etc.:
To explain my meaning, I say that my intent is not here in this Book of my self to decide and determine this or that is a Custom, but to set down what I have read and seen in the same Rolls aforesaid, and to direct the Readers easily how to find in the same Rolls the matters touching the Customs hearafter following (leaving the judgement thereof unto the Learned and those which have knowledge): And further to instruct in the Customs those which shall be hereafter officers, and ignorant of them: That thereby the true and perfect Customs may be the better observed and kept, and Contention which may happen between the Lord and Tenants the better be avoided.
The information he retrieved from the Court Rolls follows and includes these items applicable to Bosbury:
Inheritance.
If a Customary Tenant die seised of Customary Lands of estate aforesaid, and have no son, then is the eldest daughter presented and admitted the Lord’s Tenant (as the son should have been, if the Tenant had had a son) (except in the four Manors as aforesaid, where the youngest son of sons, if he have sons, and if no son, then the youngest daughter of daughters is presented and admitted as aforesaid). The like order and Custom is for every person which is presented heir by the Custom, being next of kin to such a Tenant as dieth seised as aforesaid without heir of his own body. This article I think will not be denied of any: therefore I pass it over without further proof.
Widow’s rights.
That the first wife of every Customary Tenant who dies seised of Customary Lands held by Copy of Court Roll ‘sibi et suis’ shall be admitted to her free bench (without paying any fine for the same unto the Lord) is very apparent in the Court Rolls to be the very Custom (and is not denied of any).
The Custody of the Customary Tenant’s children presented for heir.
How the heirs of Customary Tenants which die seised of estate by the Custom ‘Tenendum sibi et suis et cet.’: and to whom the Customary Land his ancestor died seised of were next to be granted unto, if the child were of age: That such heir and the land his ancestor died seised of by the Custom shall be in the Lord’s custody until he come to full age to be the Lord’s Tenant: And how, during such child’s nonage [the period of legal minority, or of an age below 21] the Lord hath granted the custody and government of the child and the Customary Land he should be Tenant unto, to whom the Lord will (and have had fines therefore) See in the Court Rolls, viz. An. R.R. Ed. iii 31, 32, 33. Item An.R.R. Hen.VIti 23. Item An. R.R. Elizabethae 2, 4,12, 18, 20 ,21.
Surrenders.
In the Court Rolls it plainly appears that Customary Tenants have
used (and that it is a good custom) to surrender the Customary Lands they hold by Copy
to the use of one, two or three, by surrendering the same out of Court to the Steward,
Surveyor, Receiver, or baylie of
that Manor (being the Lord’s officers) or unto two CustomaryTenants: To testify
the same in the Lord’s Court. Also that they surrender in Court to the use of
themselves and other.
But when a surrender is made out of Court or in Court (I am persuaded) it is
in the Lord’s choice whether he will accept of such surrender: for that the
Lord (as I think) may choose to make any grant from the very Tenant (which is
Tenant by descent unto his ancestor): which if the Lord do, then is he, to
whose use the surrender is testified and made, to agree at the Lord’s pleasure for
the grant of the same Customary Land.
If a woman under ‘covert baron’ surrender Customary Lands, she is to be secretly examined in Court by the Steward,if she do it for fear, or is threatened by her husband et cet. (as at the common law) : And she must bring her husband with her to be present in Court at the making of the surrender (whereby it may appear unto the Court that he doth assent unto the surrender then to be made by his wife): That this hath been the use by the Custom is very apparent in the Court Rolls.
Heriots
It is very apparent in the Court Rolls that every Customary Tenant who dies seised of Customary Lands ‘sibi et suis’, or for Term of Life only, do pay for every messuage and for every toft (which was sometime a messuage) his best beast: viz. so many messuages or tofts for which heretofore heriot hath been paid, so many his best beast.
Memorandum. Customary Tenants by agreement between the Lord and them have accepted to pay to the Lord for heriot at their decease for every messuage xxvis. viii d. [£1 6s. 8d.] or their best beast at the choice of the Lord: which agreement for heriot against that Tenant is good by Law, as I have heard some say which are learned.
